Submitting a notification to the Prosecutor’s Office on suspicion of committing a crime by former members of the Company’s Management Board

Management Board of PKP CARGO S.A. (the “Company”) informs that today it submitted to the District Prosecutor’s Office in Warsaw a notification on the suspicion of committing a crime to the detriment of the Company by persons who are Members of the Management Board of PKP CARGO S.A. in the years 2022 – 2023. During the period of performing their functions, irregularities were identified resulting from failure to fulfill their obligations to exercise due diligence resulting from the professional nature of their activities, which became the basis for submitting a notification on the suspicion of committing a crime to the detriment of the Company under Art. 304 § 1 of the Code of Criminal Procedure

The notification concerns the implementation by the above-mentioned Members of the Management Board of PKP CARGO S.A., without an appropriate legal basis and proper protection of the Company’s interests, the decisions of the Prime Minister of July 25 and October 6, 2022 on the transport of coal, which led to the Company causing material damage to the property of PKP CARGO S.A., loss of significant revenues and expected benefits.
