Decision to open restructuring proceedings

Management Board of PKP CARGO S.A. (the “Company”) informs that on July 25, 2024, it received from the District Court for the Capital City of Warsaw Warsaw in Warsaw, 18th Commercial Division, “Notice of the decision to open restructuring proceedings” (no. 20240725/00201) of July 25, 2024, in which the Court decided:

– open restructuring proceedings for the debtor, which is PKP CARGO S.A.,
– pursuant to Article 288(3) of the Act r. allow the debtor to manage the entire enterprise to an extent not exceeding the scope of ordinary management,
– appoint a manager whose function will be performed by: Izabela Skonieczna-Powąka (license no. 772),
– indicate that the basis for the jurisdiction of Polish courts is Article 3(1). Regulation (EU) 2015/848 of the European Parliament and of the Council of 20 May 2015 on insolvency proceedings (OJ 2015, No. 141, p. 19, as amended), and the proceedings has character
