Information on the maintenance of the application to open the restructuring proceedings of PKP CARGOTABOR Spółka z o.o.

The Management Board of PKP CARGO S.A. in restructuring with its registered office in Warsaw (“Issuer”, “Company”) hereby informs that today it received from its subsidiary PKP CARGOTABOR Sp. z o.o. (“Subsidiary”) information about the submission to the District Court for the Capital City of Warsaw in Warsaw, 18th Commercial Division for Bankruptcy and Restructuring, of a letter regarding the upholding of the application to open restructuring proceedings.

On August 9, 2024, the Subsidiary filed a motion to withdraw the motion to open the restructuring proceedings. However, as a result of the analysis of its operational and financial situation, as well as in the context of the talks with creditors, the Management Board of the Subsidiary concluded that carrying out restructuring activities is still a necessary solution from the point of view of striving to improve the financial condition of PKP CARGOTABOR Sp. z o.o. and to fully satisfy its creditors.

In connection with the above, the Subsidiary Company decided to withdraw the declaration of withdrawal of the application to open restructuring proceedings, guided by its best interests, the interests of its creditors and contractors, as well as its employees, which resulted in the submission of the above-mentioned letter supporting the application.
